Analysing the position in Kane and Kane: Are big money makers now being Kane-d when arriving at a property settlement?

For the first time since cases like Ferraro or Figgins, the Full Court of the Family Court has finally taken a definitive stance on the issue of “special contributions”. This article briefly looks at the judgment of Kane and Kane and how this affects the assessment of property issues under Section 79(4) of the Family Law Act 1975. Katrina Oner of Oner Family Law summarises the case of the Italian Sisters and the Hague Convention in this article published in the Queensland legal magazine Proctor (December 2012 edition). Due to word limitations, Katrin was unable to deal with every aspect of the case which arose. At the time the article was written, there were no further applications pending in Australian Courts, although that does not seem to be the case at the present time.
